Privacy Policy

FinCo Payment Solutions LLC respects your information. This policy explains — in plain language — what we collect, why we collect it, how we protect it, and the rights you have.

The short version

  • We collect only what you give us and basic site analytics.
  • We do not collect, store, or process card numbers, bank account numbers, or other cardholder data on this website. That's the processor's job, not ours.
  • We do not sell your information. Period.
  • Uploaded statement PDFs go to a private FinCo inbox and (optionally) a private Drive folder. We delete on request.
  • You can ask us at any time what we have, correct it, delete it, or stop hearing from us. Email drew@fincopayments.com.

1. Who we are

This site is operated by FinCo Payment Solutions LLC, a Texas limited liability company doing business as FinCo Payments and FinCo Payment Group. Our principal place of business is Austin, Texas 78728. We are an Independent Sales Organization (ISO) — a payment-processing consultancy. When this policy says "FinCo," "we," "us," or "our," we mean FinCo Payment Solutions LLC.

2. What we collect

We collect three categories of information, and only when you give it to us or interact with our site:

  • Contact information you submit — name, business name, email address, phone number, and any free-text comments you include when you fill out a form, upload a statement, or send an email.
  • Merchant statement files you upload — the processing-statement PDFs you choose to send for analysis, plus any associated metadata (filename, size, upload timestamp).
  • Standard site analytics — IP address, browser type, device type, pages visited, timestamps, referring URL, and similar diagnostic data. This is used to keep the site running and to understand which pages are useful. We may use Cloudflare's edge analytics and (if enabled in the future) Google Analytics 4.

3. What we do not collect on this website

This website does not collect or process cardholder data as defined by the Payment Card Industry Data Security Standard (PCI DSS). We do not ask for or transmit card account numbers (PANs), card verification values (CVVs), magnetic-stripe data, or PIN data through this site. If you become a FinCo-placed merchant, cardholder data is processed exclusively by our PCI-compliant processor partners under their own merchant agreements and security programs — not by FinCo's website.

We also do not knowingly collect: Social Security numbers, government ID numbers, bank account routing numbers, or financial credentials through this site.

4. How we use your information

We use your information only for legitimate, narrowly-scoped business purposes:

  • Contact information is used to respond to your inquiry, prepare and deliver your statement analysis, and follow up if you've asked us to.
  • Statement files are read by FinCo personnel (currently Drew Wisniewski) to produce a written savings analysis for your specific business.
  • If you express interest in becoming a FinCo-placed merchant, we may share the information necessary to underwrite the account with our processor partners (see Section 6).
  • Analytics data is used to improve site performance and understand which content is useful.

We do not use your information for credit checks, predictive scoring, profiling, or automated decision-making.

5. Communications and consent (TCPA · CAN-SPAM)

By submitting a form or providing your phone number, you consent to be contacted by FinCo via email, phone call, or SMS text message at the email and phone number you provide, for purposes related to your inquiry or merchant account. We will not send marketing texts using auto-dialing systems without your express prior consent in compliance with the Telephone Consumer Protection Act (TCPA).

You can opt out of all FinCo communications at any time:

  • Email: reply with "unsubscribe" or click the unsubscribe link in any marketing email (CAN-SPAM Act compliance).
  • SMS: reply STOP to any FinCo text message.
  • Phone: tell us in writing — email drew@fincopayments.com with the subject "Stop calling." We honor opt-outs within 10 business days.

6. Who we share information with

We do not sell your information. We share it only as follows:

  • Service providers we rely on to operate the site — Cloudflare (hosting + DNS + edge analytics), Google Workspace (email + Drive), Formspree or comparable form-processing service (form submissions). These providers have access to information only to the extent needed to perform their function, and each is contractually required to protect that information.
  • Processor and Super ISO partners — if you engage FinCo to place you on a payment processor, we share the underwriting information you provide (business details, ownership, processing history) with the specific processor or Super ISO partner under consideration. They have their own privacy policies and security obligations under PCI DSS.
  • Legal requirements — we will disclose information if required to do so by a valid subpoena, court order, regulatory request, or other legally binding obligation.

7. How we protect your information

We use commercially reasonable administrative, technical, and physical safeguards designed to protect your information:

  • Encryption in transit. All site traffic and form submissions travel over TLS 1.2 or higher.
  • Access controls. Statement files and contact information are accessible only to authorized FinCo personnel — currently a single principal (Drew Wisniewski).
  • Provider security. We rely on enterprise-grade providers (Cloudflare, Google Workspace) for storage and transmission, each of which maintains its own compliance certifications.
  • No public storage. Uploaded statements are never posted to a public location and are not indexed by search engines.
  • Limited retention. See Section 9.

No method of transmission or storage is 100% secure. We cannot guarantee absolute security, but we work to maintain reasonable safeguards consistent with the sensitivity of the information.

8. Your rights (CCPA · state privacy laws)

Residents of California, and of other U.S. states with comprehensive consumer privacy statutes (including Virginia, Colorado, Connecticut, Utah, Texas, Oregon, Montana, and others), have specific rights regarding personal information. These include:

  • The right to know what personal information we have collected about you.
  • The right to access and obtain a copy of that information.
  • The right to correct inaccurate information.
  • The right to delete personal information (subject to limited exceptions for legitimate ongoing business or legal needs).
  • The right to opt out of the "sale" or "sharing" of personal information. We do not sell or share personal information for cross-context behavioral advertising — there is nothing to opt out of, but you may submit a request anyway.
  • The right to non-discrimination for exercising any of these rights.

To exercise any of these rights, email drew@fincopayments.com with the request and reasonable proof of identity. We will respond within the timeframe required by applicable law (typically 45 days under CCPA).

9. How long we keep your information

We retain information only as long as needed:

  • Contact information — retained while your inquiry or merchant relationship is active, plus 7 years for accounting and tax records, then deleted.
  • Uploaded statement files — retained while we are preparing or delivering your analysis, plus a reasonable window for reference (up to 12 months). Deleted on your request at any time.
  • Site analytics — aggregated and anonymized within 14 months per Google Analytics defaults; raw logs retained ≤30 days at Cloudflare's edge.

10. Cookies and tracking technologies

This site uses a small number of cookies and similar technologies for essential functions and basic analytics. We do not use third-party advertising cookies and do not participate in cross-site behavioral advertising networks. Specifically:

  • Strictly necessary cookies for security, load balancing, and basic site function (set by Cloudflare).
  • Analytics cookies for understanding aggregate site usage (Google Analytics 4 may be enabled in the future).

You can disable cookies in your browser settings. Disabling strictly necessary cookies may break parts of the site.

11. Children's privacy (COPPA)

This site is for business users and is not directed to children under 13. We do not knowingly collect personal information from children under 13. If you believe a child has provided us with information, contact drew@fincopayments.com and we will delete it.

12. International users

FinCo Payment Solutions LLC is based in the United States. If you access this site from outside the U.S., you understand that your information will be transferred to, stored, and processed in the United States, subject to U.S. law. We do not currently target services outside the U.S.

13. Changes to this policy

We may update this policy from time to time to reflect changes in our practices, technology, legal requirements, or for other reasons. When we do, we will update the "Effective" date at the top and increment the version. Material changes will be posted prominently on the site.
