About these terms
These Terms of Use govern your access to and use of fincopayments.com, operated by FinCo Payment Solutions LLC, a Texas limited liability company. By using this site, you agree to these terms. If you don't agree, please don't use the site.
Who FinCo is
FinCo Payment Solutions LLC (doing business as FinCo Payments and FinCo Payment Group) is an Independent Sales Organization (ISO) — a payment-processing consultancy that places merchants on the processor and pricing model that best fits their business.
What this website does, and doesn't do
This website is informational and a point of contact. It is not, by itself, an offer to enter into a payment-processing agreement. Any actual placement of a merchant on a processor is governed by separate written agreements signed by the merchant, FinCo, and the processor.
Statement analyses, savings projections, and pricing comparisons presented on this site or returned to you after a statement upload are estimates based on the information you provide. Actual processing costs depend on card mix, transaction patterns, network rules in effect at the time, and other factors. We don't guarantee specific savings amounts.
Your use of the site
You agree to use the site lawfully, not to upload malicious files, not to scrape or copy substantial portions of the content, and not to misrepresent who you are when contacting us.
Statement uploads
When you upload a merchant statement, you represent that you are authorized to share that document with FinCo. You retain ownership of the document. We use it to produce your analysis and may retain it for our records unless you ask us to delete it. See the Privacy Policy for handling details.
Third-party services
This site relies on third-party services (Cloudflare for hosting, Formspree for form submissions, Google Workspace for email, Netlify for one embedded tool, and the rewards portal hosted at rewards.fincopayments.com). Those services have their own terms; their availability and behavior are outside our control.
Intellectual property
The content on this site — copy, design, brand marks, code — is owned by FinCo Payment Solutions LLC. You may not reuse it for commercial purposes without permission. Processor partner names (Hawthorn, Netevia, Luqra, Cliq, PayArc, Spartan POS, and others) belong to their respective owners; we use them descriptively to describe what we do.
Disclaimer of warranties
This site is provided "as is." We work to keep it accurate and available, but we don't warrant uninterrupted availability, error-free operation, or that the information is current at every moment.
Limitation of liability
FinCo's liability arising out of your use of this website (as distinct from a signed processing agreement) is limited to the amount you've paid us, if any, for the use of the website itself — which is zero. We are not liable for indirect, incidental, or consequential damages arising from the website.
Governing law
These terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws principles. Any dispute that can't be resolved informally will be heard in the state or federal courts located in Travis County, Texas.
Changes
We may update these terms from time to time. The "Last updated" date at the top reflects the most recent change. Continued use of the site after a change means you accept the updated terms.
